End User License Agreement

This End User License Agreement ("EULA") is a legal agreement between you ("User") and Outspiral("Licensor") for the use of the Outspiral mobile application ("App"), available through the Apple App Store.

By downloading, installing, or using the App, you agree to be bound by this EULA. If you do not agree, do not use the App.

1. License Grant

The Licensor grants you a non-exclusive, non-transferable, revocable license to download, install, and use the App on any Apple-branded device that you own or control, subject to the Apple App Store Terms of Service and this EULA.

2. Restrictions

You may not:

  • Copy, modify, distribute, sell, lease, sublicense, or create derivative works of the App
  • Reverse-engineer, decompile, disassemble, or attempt to derive the source code of the App
  • Remove, alter, or obscure any proprietary notices, labels, or marks in the App
  • Use the App for any commercial purpose not expressly permitted
  • Use the App in any way that violates applicable laws or regulations

3. Subscription Services

The App offers a free tier and an optional Pro subscription. Subscription purchases are processed through the Apple App Store. Subscription terms, pricing, renewal, and cancellation are governed by Apple's terms and our Terms of Service.

4. Third-Party Services

The App integrates with the following third-party services:

  • Google Firebase: authentication and secure cloud data storage
  • RevenueCat: subscription management and receipt validation

Your use of these services is subject to their respective privacy policies and terms of service. The Licensor is not responsible for the practices of third-party service providers.

5. Intellectual Property

The App and all content, features, functionality, graphics, trademarks, and code are the exclusive property of the Licensor and are protected by applicable intellectual property laws. This EULA does not grant you any ownership rights in the App.

6. No Warranty

The App is provided "AS IS" and "AS AVAILABLE" without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

The Licensor does not warrant that the App will be uninterrupted, error-free, or free of harmful components. The App is a self-support tool and does not provide medical advice, diagnosis, or treatment.

7. Limitation of Liability

To the maximum extent permitted by applicable law, the Licensor shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of or inability to use the App, even if advised of the possibility of such damages.

8. Apple-Specific Terms

This EULA is between you and Outspiral only, not Apple. The following terms apply as required by Apple:

  • Acknowledgement: Apple has no obligation to furnish any maintenance or support services with respect to the App.
  • Product claims: Outspiral, not Apple, is responsible for addressing any claims relating to the App, including product liability claims, claims that the App fails to conform to applicable legal or regulatory requirements, and claims arising under consumer protection or similar legislation.
  • Intellectual property: In the event of any third-party claim that the App infringes that third party's intellectual property rights, Outspiral, not Apple, is solely responsible for the investigation, defense, settlement, and discharge of such claim.
  • Third-party beneficiary: Apple and its subsidiaries are third-party beneficiaries of this EULA. Upon your acceptance, Apple will have the right to enforce this EULA against you as a third-party beneficiary.
  • Compliance with App Store Terms: You must comply with any applicable third-party terms when using the App, including the Apple App Store Terms of Service.

9. Termination

This EULA is effective until terminated. Your rights under this EULA will terminate automatically if you fail to comply with any of its terms. Upon termination, you must cease all use of the App and delete all copies from your devices.

10. Governing Law

This EULA is governed by and construed in accordance with the laws of Sweden, except to the extent superseded by applicable Apple App Store terms.
